What Citizenship Changes About Buying Property in Ghana
Ghana runs on leaseholds. You hold land for a fixed term under a document, not forever.
Section 10 of the Land Act 2020 (Act 1036) sets the boundary. A non-citizen holds no freehold interest in Ghanaian land, and any deed granting one is void. The leasehold ceiling for a non-citizen is fifty years at any one time. Citizens hold longer, commonly 99 years on state and stool land.
Three details catch people out:
- Marriage to a citizen does not lift the restriction. Neither does a partnership with one.
- A company counts as non-citizen once more than forty percent of the shareholding sits with non-citizens. A UK company will not extend your term.
- Tax residence differs from citizenship. Non-residents pay 15 percent on gross rent, residents 8 percent on residential rent.

What Happens at Year 50
The ceiling applies at any one time, so renewal stays open, though never automatically. Three points decide your position.
Who grants renewal. On state land, the Lands Commission acts for the grantor. On stool land, the stool grants through the Customary Land Secretariat. Your sub-lease names the party.
On what terms. Ground rent and premium reset at renewal date, not at 2026 rates. A clause naming a formula protects you better than one naming goodwill.
What your heirs take. The remaining years plus the renewal right written into the document. Eight years left and no renewal clause makes a depreciating asset.
What You Own as a Non-Citizen
You own the apartment. The unit, the finishes, the right to rent, sell, or pass on. The land underneath reaches you as a leasehold interest through a sub-lease from the developer.
Ask for two numbers in writing before signing: the head lease term over the site, and the sub-lease term granted to you.
Buying From Abroad and Getting Money Out
Residency is not a precondition. Buyers in London, Maryland, and Toronto reserve, sign, and pay in stages without boarding a plane. A power of attorney covers signatures when travel proves hard.
Money moves both ways under the Foreign Exchange Act 2006 (Act 723). Send purchase funds through an authorised dealer bank and keep the inward remittance advice. Under Bank of Ghana rules, resident buyers pay in cedis. A developer may invoice a non-resident buyer in foreign currency, paid into a foreign exchange account at the bank market rate. Registering with the Ghana Investment Promotion Centre secures transferability of net profits and sale proceeds in convertible currency, net of tax. Paying outside the banking system creates the paperwork gap stalling repatriation.
The Checks Worth More Than Your Passport
Citizenship protects nobody from a bad title. Every buyer runs the same five checks:
- Official search at the Lands Commission on the parcel, report in hand
- Written proof of the seller or developer’s authority to sell
- Lease term, renewal clause, and ground rent, read line by line
- Building permit and planning approval for the development
- An independent lawyer, not the seller’s, reviewing before money moves
Three Claims to Push Back On
- “Family land at half price, straight from the chief’s family.” The most common pitch to diaspora buyers, and the most common loss. Stool and family land carries multiple claimants, and no non-citizen holds freehold over any of it.
- “The developer said 99 years, so I get 99 years.” Your status and the sub-lease decide.
- “Property ownership leads to a residence permit.” No. Different authority, different process.
Ghana Against Dubai and London
Dubai offers freehold to foreigners. Ghana does not. The trade sits in the yield. Prime Accra apartments run at 8 to 11 percent gross, 4 to 7 percent net after costs and tax, against 3 to 5 percent on UK stock. Studios in Airport City and Ridge clear 10 percent or more.
