A resale apartment advertised as a 99-year lease, granted in 1968, leaves 41 years today. The label sounds generous. The residue tells the truth.
What a Lease Means Here
The most common interest conveyed in land in Ghana is the leasehold interest. A lease grants you the right to hold and use land for a fixed term. At the end, the interest returns to the grantor unless you renew. The Land Act, 2020 (Act 1036) (the “Land Act”) outlines every land interest, from allodial title to customary tenancy. Regarding leasehold interests, two numbers dominate the market: 50 and 99.
The 50-Year vs 99-Year Property Lease in Ghana Split
Generally, a person who purchases property in Ghana may obtain a leasehold interest of up to 50 or 99 years. Citizenship sets the maximum term. Article 266(4) of the 1992 Constitution, restated in Section 10(6) of the Land Act, caps the leasehold interest transferable to non-citizens at 50 years at any one time. Ghanaian citizens may hold a leasehold interest of up to 99 years at a time.
Marriage to a citizen does not lift the cap. A company counts as a non-citizen, for purposes of land acquisition in Ghana, when more than forty percent of its equity sits with non-citizens – thus registering a local company solves nothing without majority Ghanaian ownership.

Non-Ghanaians cannot hold a freehold interest in any land in Ghana. Also, Ghanaians cannot obtain freehold interests in land from any stool, skin, clan or family.
Apartments Work Differently
You are not buying land under a tower. Under the Land Act, a parcel of land and the building thereon are considered as one entity for the purposes of the title transfer. - The head lease start date
- The years remaining on the head lease
- Your sub-lease term
A sub-lease is always for a period less than the head lease above.
The limitations on apartment ownerships are the same as those stated above for land ownership. Non-citizens can register their interest in their own name at the Lands Commission with no nominee or local partner. The limitations are placed on duration of interest and the kind of interest that can be conveyed, and not your right to hold title.
Moving From 50 to 99 Years
For purposes of land acquisition, dual citizens are entitled to the longer term of 99 years, as Ghanaian citizens. Children born abroad to dual citizens claim Ghanaian citizenship by descent, with registration required before age 21.
An individual with a Right of Abode is not a citizen. Holders remain limited to the maximum leasehold period of 50 years. A Ghana Card proves identity, not citizenship. If a parent or grandparent was Ghanaian, open the citizenship file before you start viewings.
When the Term Ends
Under section 50 of the Land Act, persons are guaranteed renewal of their leasehold interest if the lease provides for renewal. Automatic renewal of interests for both Ghanaians and non-Ghanaians apply in very limited instances, Renewal is never free, and would be in accordance with agreed terms.
No official/published tariff exists for renewal of leasehold interests as yet. The landowner sets a fresh premium. Improvements to the land revert (together with the land) to the landowner at the expiration of the leasehold interest. Open the conversation two to five years ahead.
What Your Children Receive
Ghana levies no inheritance tax , and foreign nationality does not remove entitlement. You can transfer your outstanding interest in the property under a will, under a deed of gift or place the property in a trust in favour of your children.

Lenders price against years left. Your future buyer inherits a shorter clock than you did. A 45-year residue suits a buyer at sixty and frustrates a 34-year-old planning a family handover.
